General Terms and Conditions – Segment Studio

Article 1 - Identity of the business. Studio DF VOF, trading under the name Segment Studio. Registered and visiting address: Spoorzicht 11, 1749 MW Warmenhuizen, the Netherlands. Article 2 - Applicability. These terms and conditions apply to every offer from Segment Studio and to every distance contract concluded between Segment Studio and the consumer. Before the contract is concluded, the text of these terms and conditions is made available electronically so that the consumer can easily save it.

Article 3 - The offer and the contract. All Segment Studio products are made-to-order, personalised products: a unique work of art based on the route and details supplied by the consumer. The offer contains a full description and images; obvious mistakes or errors are not binding on Segment Studio. The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions. Segment Studio confirms receipt of the order electronically.

Article 4 - Prices and payment. The prices stated are in euros and include VAT, excluding any shipping costs shown before completing the order. Payment is made via the payment methods offered in the webshop at the time of ordering.

Article 5 - Delivery and performance. Segment Studio delivers within the stated periods. Shipping within the Netherlands is free, to the EU €5.95 and to other countries €19.95. Your order is usually shipped within 2-4 business days. The stated periods are indicative. The risk of damage and/or loss lies with Segment Studio until the moment of delivery.

Article 6 - Right of withdrawal and its exclusion. For most distance products a statutory cooling-off period of 14 days applies. However, under Article 6:230p subsection f of the Dutch Civil Code, the right of withdrawal is excluded for products made to the consumer's specifications that are not prefabricated and that are made on the basis of an individual choice or decision by the consumer, or that are clearly intended for a specific person. Because Segment Studio's products are made entirely to order and personalised, they cannot be returned or cancelled once production has started. The consumer is expressly informed of this before purchase and agrees to it when placing the order.

Article 7 - Gift cards. Gift cards are valid for 24 months after purchase and can be redeemed for the entire range. A gift card cannot be exchanged for cash. Shipping costs are calculated upon redemption (free within the Netherlands; other zones according to the shipping policy). An unredeemed gift card can be withdrawn within 14 days of purchase.

Article 8 - Conformity and complaints. Segment Studio warrants that the products comply with the contract and with reasonable requirements of soundness and quality. Has a product arrived damaged or does it differ from the order? Then contact us within a reasonable time, no later than 14 days, at info@segmentstudio.nl with photos substantiating the damage or discrepancy; we always look for a suitable solution (repair or replacement). This conformity guarantee does not affect the exclusion of the right of withdrawal in Article 6.

Article 9 - Liability. Segment Studio's liability is limited to no more than the invoice amount of the relevant order, except in the case of intent or gross negligence. The consumer is responsible for the accuracy of the details supplied (route, title, texts, dates).

Article 10 - Intellectual property. All rights to the designs, templates and the webshop belong to Segment Studio. The consumer obtains the delivered product for personal use and declares to be entitled to use (or have used) the details supplied.

Article 11 - Personal data. Segment Studio processes personal data in accordance with the GDPR and the privacy policy published on the website.

Article 12 - Applicable law and disputes. Dutch law applies exclusively to contracts. Disputes are submitted to the competent court of the Noord-Holland District Court, Alkmaar location.
